Brand and Events Marketing Documentation

Gem’s Brand and Events Marketing Services enable you to create public websites (“Landing Pages”) that match the look and feel of your company’s brand and are directly integrated with your Gem instance. We will keep this page updated with information about the administrative, technical and operational practices that apply to your use of Landing Pages. 

Landing Pages Content. 

  • Brand and Events Marketing customers may configure their Landing Pages by incorporating visual content (e.g. images, videos), branding, URLs, text and other look and feel elements (“Customer Content”). You determine the Customer Content that is submitted to the Services for use in your Landing Pages, and so you are solely responsible for its accuracy, quality and legality and for ensuring that you have secured all rights necessary for the use of Customer Content as part of your Landing Pages. Customer Content is your Customer Data, but please be aware that it will be viewable by visitors to your Landing Page, and accordingly Customer Content is not considered confidential information under the Agreement.

  • Landing Pages customers may also choose to incorporate into their Landing Pages forms to collect information from candidates that visit their Landing Pages, which information may include names, email addresses and other information voluntarily provided by the candidate (“Candidate Content”). Candidate Content that is submitted through a Gem Landing Page will be added to the Customer’s Gem instance or Applicant Tracking System. You determine the Candidate Content that is collected through your Landing Pages and content of the Candidate Content collection forms, and so you are solely responsible for ensuring that the collection and processing of Candidate Content contemplated by these terms complies with applicable laws, and for providing or obtaining any legally required notices or consents. 

Landing Pages Data Processing. 

  • Gem uses technology provided by a third party, Unrolled LLC, to power the editor for Landing Pages. By using Landing Pages, you consent to Gem’s use of Unlayer as a sub-processor, and instruct Gem to submit your data to Unlayer for processing in support of the Brand and Events Marketing Services. 

  • Gem uses Google Analytics to track Landing Page traffic. Google Analytics is a web analytics service offered by Google. Google uses the data collected to track and monitor the use of Landing Pages, and Gem makes available to Brand and Events Marketing Services customers analytics about the usage of that customer’s Landing Pages. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.   • You are solely responsible for posting an appropriate privacy policy on your Landing Page and disclosing to your Landing Page site visitors the use of Google Analytics and how it collects and processes data. To learn more about using Google Analytics, visit their help center.

  • Upon your request, we can disable all tracking for your Landing Page. This will remove Google analytics tracking and analytics will no longer be visible in your dashboard. To disable tracking, email support@gem.com.

Landing Pages Support; Data Portability and Deletion.

The following support, data portability and deletion terms apply to the Brand and Events Marketing Services, instead of any similar terms that may apply to other Services that you purchase from Gem:  

  • No service level or support agreement in place between Customer and Gem applies to the Brand and Events Marketing Services.

  • Landing Pages customers may request an export of Candidate Content that was submitted through a Landing Page and added to the customer’s instance of the Services by emailing support@gem.com. This export will not include any Landing Page site code, or any Customer Content from the Landing Page, and those Landing Page elements will not be accessible or retrievable after you stop using the Brand and Events Marketing Services. 

  • Following termination of your use of the Brand and Events Marketing Services, Gem will have no obligation to maintain any Landing Pages, Customer Content or Candidate Content. At Customer’s request or otherwise, Gem will, unless legally prohibited, deprecate Landing Pages and delete Customer Content and Candidate Content in its systems or otherwise in its possession in accordance with its standard schedule and procedures.
